Terms governing use of the Houspire Platform and Services

1. Acceptance of Terms
1.1 By accessing or using the Houspire website, mobile application, customer dashboard or services (collectively, the "Platform"), you agree to these Terms & Conditions ("Terms"), the Privacy Policy, Refund & Cancellation Policy and other policies expressly incorporated by reference.
1.2 These Terms form a legally binding agreement between you and ARMISHQ DESIGN PRIVATE LIMITED, having its registered office at Plot No. 67, Road No. 4, Prashasan Nagar, Jubilee Hills, Hyderabad - 500033, Telangana, India (referred to as "Houspire", "we", "us" or "our").
1.3 You must be at least 18 years old and legally capable of entering a contract to purchase or use the Services.
1.4 We may update these Terms. The version applicable when an Order is placed will govern that Order, unless a change is required by law or is more favourable to the Customer.
2. Definitions
- Services: Online interior design consultation, designer-created 3D renders, transparent budget estimates, material-vendor connections and related digital services expressly included in an Order.
- Customer or you: A person who purchases or uses the Services.
- Designer: An interior design professional assigned by Houspire to fulfil an Order.
- Order: A purchase of a package, room, view, add-on or other Service through an authorised Houspire channel.
- Deliverables: The renders, budget documents, vendor information and other digital outputs expressly included in an Order.
- Design consultation call: The scheduled consultation in which the Designer gathers and confirms the Customer's design requirements.
3. Description and Scope of Services
3.1 Houspire provides design-only digital Services. The exact rooms, views, Deliverables, revision entitlement, price and applicable taxes are those displayed and accepted at checkout or otherwise confirmed in writing for the Order.
3.2 The Services may include design consultation, designer-created 3D visualisations, itemised or indicative budget documents and connections to independent material vendors.
3.3 Unless expressly stated in the Order, the Services do not include:
- physical construction, interior execution or installation;
- project management or on-site supervision;
- architectural, civil, structural or building-code certification;
- material procurement, supply, contracting or vendor management;
- post-construction maintenance; or
- a warranty regarding execution quality or third-party performance.
3.4 Any add-on or additional view is governed by the scope, price and delivery commitment shown when purchased.
4. Account Registration and Security
4.1 You may be required to create an account and provide accurate, complete and current information. You are responsible for maintaining the confidentiality of your login credentials.
4.2 Notify Houspire promptly of suspected unauthorised access. We may suspend or terminate an account for fraud, misuse, false information or material breach of these Terms.
5. Ordering, Pricing and Payment
5.1 An Order is placed when you select the Services, provide the requested project information and successfully complete payment.
5.2 Current prices, package contents, add-ons and taxes are displayed at checkout or confirmed in writing before payment. Prices may change for future Orders without affecting an already accepted Order.
5.3 Payments are processed through Razorpay or another authorised payment provider. Full payment is required unless Houspire expressly agrees otherwise in writing.
5.4 GST invoices and transaction records will be issued and retained in accordance with applicable law.
6. Design Consultation and Customer Inputs
6.1 Delivery depends on the completion of the design consultation call and receipt of accurate measurements, floor plans, photographs, requirements, preferences and approvals reasonably required for the Order.
6.2 You are responsible for the accuracy and completeness of all information supplied. Houspire is not responsible for design, budget or spatial differences caused by inaccurate or incomplete inputs.
6.3 If required information is missing, inaccurate, changed or supplied late, the delivery period pauses until Houspire receives what is needed to continue.
7. Delivery
7.1 The 72-hour delivery period begins when the scheduled design consultation call is completed.
7.2 The period is calculated as elapsed hours, except that hours falling on Sundays and public holidays officially observed in Telangana are excluded. Saturdays are included unless they are an officially observed public holiday.
7.3 Delivery occurs when the complete initial Deliverables included in the Order are made available through the customer dashboard or sent to the Customer's registered email address.
7.4 Customer-requested revisions after timely initial delivery do not form part of the 72-hour delivery period.
8. Revisions and Changes
8.1 Revision entitlements are determined by the package or Order purchased. Revisions may include reasonable changes to colours, furniture, layout, materials or budget direction within the agreed scope.
8.2 Revisions do not include a new property, additional room, additional view, materially changed measurements, complete redesign, new style direction or expanded scope unless separately purchased or agreed.
8.3 Additional revisions or expanded work may require an additional fee and revised delivery timeline.
9. Intellectual Property
9.1 Subject to full payment, the Customer may use the final Deliverables for personal planning and execution of the property identified in the Order.
9.2 Houspire retains ownership of its brand, Platform, software, workflows, templates, methods and other pre-existing intellectual property.
9.3 You may not resell the Deliverables as a design service, commercially exploit Platform components, remove proprietary notices, or reverse-engineer or interfere with the Platform.
9.4 Houspire will not publicly use identifiable project files or Deliverables for marketing without permission, except in anonymised or aggregated form where lawful.
10. User Obligations and Prohibited Conduct
You agree to use the Platform lawfully, provide accurate information, cooperate reasonably with the design process and avoid uploading unlawful, infringing, harmful or malicious content. You must not attempt unauthorised access, disrupt Platform security, harass personnel or misuse payment and refund processes.
11. Designer Assignment and Communication
Houspire may assign or reassign Designers based on expertise and availability. Primary communication and delivery may occur through the dashboard, email, telephone or WhatsApp. Calls and support are subject to the purchased Order and reasonable scheduling availability.
12. Refund and Cancellation
12.1 A Customer is eligible for a full refund only if Houspire fails to complete initial delivery within the applicable 72-hour period calculated under Section 7, and that failure is attributable to Houspire.
12.2 No refund is available for change of mind, dissatisfaction with a selected style or preference, postponement, budget changes, engagement of another designer, customer-caused delay, a changed scope, or revisions requested after timely initial delivery, except where a remedy is required by applicable law.
12.3 Refund eligibility, exclusions, request procedure and processing are governed by the Refund & Cancellation Policy published on the Platform. Refund requests must be sent to hello@houspire.ai.
13. Design, Budget and Vendor Disclaimers
13.1 Renders and layouts are conceptual visualisations. Physical colours, textures, lighting, dimensions, clearances and executed results may differ.
13.2 Budget documents are indicative estimates based on available information and market conditions. Actual prices may vary by location, labour, transport, availability, vendor and time of purchase.
13.3 Vendor information is provided for convenience. Vendors are independent third parties, and Houspire does not guarantee their pricing, availability, conduct, quality, delivery or performance.
13.4 Customers should obtain professional architectural, structural, engineering and code-compliance advice before executing work or making structural, electrical or plumbing changes.
14. Limitation of Liability
14.1 To the maximum extent permitted by law, Houspire is not liable for indirect, incidental, special or consequential loss arising from construction, execution, contractor or vendor acts, material variation, inaccurate customer inputs or use of conceptual Deliverables.
14.2 Houspire's aggregate liability arising from an Order will not exceed the amount actually paid for that Order, except where liability cannot lawfully be excluded or limited.
15. Indemnification
To the extent permitted by law, you agree to indemnify Houspire against third-party claims, losses and reasonable costs arising from your unlawful use of the Platform, breach of these Terms, infringement of another person's rights or misuse of Deliverables.
16. Force Majeure
Houspire is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil disturbance, governmental action, widespread infrastructure failure, telecommunications outage or similar events. This clause does not remove any non-waivable right under applicable law.
17. Suspension and Termination
You may stop using the Platform or request account closure. Houspire may suspend or terminate access for fraud, non-payment, unlawful activity, abusive conduct, security risk or material breach. Provisions intended to survive termination, including payment, intellectual-property, disclaimer, liability and dispute provisions, will continue to apply.
18. Dispute Resolution
18.1 Before commencing formal proceedings, contact legal@houspire.ai and allow the parties a reasonable opportunity, ordinarily 30 days, to attempt informal resolution.
18.2 Subject to non-waivable consumer rights, unresolved disputes will be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted in English by a sole arbitrator, with Hyderabad, Telangana as the seat and venue.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to the arbitration clause and applicable consumer law, courts at Hyderabad, Telangana will have jurisdiction.
20. General Provisions
These Terms and incorporated policies form the entire agreement concerning the Order. If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a right is not a waiver. You may not assign an Order without Houspire's written consent; Houspire may assign its rights as part of a lawful reorganisation or transfer of business.

22. Acknowledgment
By clicking an acceptance checkbox, placing an Order or using the Platform, you acknowledge that you have read, understood and agreed to these Terms and the incorporated Privacy and Refund & Cancellation Policies.
